Terms of Service

These Terms of Service ("Terms") govern your access to and use of the TradePipe website (tradepipe.net) and the TradePipe data services (together, the "Service"). By requesting a sample, starting a trial, or subscribing, you agree to these Terms. If you are using the Service on behalf of a company, you represent that you have authority to bind that company.
1. What the Service is
TradePipe monitors publicly available building-permit records published by municipal governments (currently the City of Austin, Texas) and delivers filtered, formatted extracts of those records to subscribers by email and/or shared spreadsheet, typically on a daily schedule. The Service is business-to-business market intelligence. It is not a consumer reporting agency, does not furnish consumer reports, and must not be used to determine any person's eligibility for credit, insurance, employment, or housing.
2. Data source and accuracy
All permit data originates from official government public records. We clean, filter and format that data, but we do not create it and cannot guarantee its accuracy, completeness or timeliness. Government sources may contain errors, publish late, change formats, or become temporarily unavailable. The Service and all data are provided "as is" and "as available." You are responsible for verifying any record before relying on it — every delivered record includes a link to the issuing government's own detail page for that purpose.
3. Acceptable use — read this section
No marketing consent is provided or implied. Permit records are public information, but the persons and businesses named in them have not consented to receive marketing communications. TradePipe data is not for cold-calling or text-message marketing.
- You must not use the data to place marketing calls or send marketing text messages (SMS/MMS) to any number contained in the data. Doing so may violate the U.S. Telephone Consumer Protection Act (TCPA), the FCC's implementing rules, state telemarketing laws (including Texas Bus. & Com. Code ch. 302 and similar statutes), and Do-Not-Call regulations.
- If you contact anyone identified in the data by any regulated channel, you are solely responsible for your own legal compliance, including TCPA, DNC-registry scrubbing, CAN-SPAM, and any state-law equivalents. TradePipe provides no consent, no DNC scrubbing, and no compliance advice.
- Permitted uses include: neighborhood canvassing around active jobsites, direct mail, route planning, competitive and market analysis, and internal business intelligence.
- You must not resell, redistribute, sublicense, publish or share the data feed outside your own company; one subscription covers one company. You must not scrape, crawl, or programmatically bulk-extract the Service.
- You must not use the Service for any unlawful purpose, including harassment, stalking, or discrimination.
We may suspend or terminate accounts that violate this section, without refund of the current billing period.
4. Subscriptions, trials and billing
- Paid subscriptions are billed monthly, in advance, at the price displayed at checkout. Payments are processed by our merchant of record; your card statement may reflect their name.
- New subscriptions may include a 7-day free trial. A valid payment method is required to start the trial; you will not be charged until the trial ends, and you can cancel at any time during the trial at no cost.
- Founding pricing, where offered, remains in effect for as long as the subscription stays continuously active.
- You can cancel at any time from any digest email or by emailing [email — enable JavaScript]. Cancellation takes effect at the end of the current billing period; you keep access until then. We do not use retention calls or cancellation fees.
5. Refund policy — the 20-permit guarantee
If your first 30 days of a paid subscription deliver fewer than 20 new permits for your selected trade and service area, email us within 40 days of your first charge and we will refund that charge in full. One guarantee claim per company. Beyond the guarantee, monthly fees for periods already billed are non-refundable, but you can cancel future billing at any time. Nothing in this section limits any non-waivable statutory rights you may have.
6. Intellectual property
The underlying public records are not owned by anyone. The TradePipe compilation — our selection, cleaning, enrichment, formatting and delivery — along with the TradePipe name, logo, website and software, are our property. Your subscription grants you a limited, non-exclusive, non-transferable license to use the delivered data within your own company for your own business purposes.
7. Disclaimers and limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNTS YOU PAID US IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
You will indemnify and hold us harmless from claims arising out of your use of the data in violation of Section 3, including any TCPA or telemarketing claim resulting from your outreach activities.
8. Changes to the Service or Terms
We may update the Service and these Terms. Material changes will be announced by email to active subscribers at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.
9. Governing law
These Terms are governed by the laws of the Republic of Estonia, without regard to conflict-of-law rules, and any disputes will be resolved in the courts of Estonia — except where the mandatory consumer-protection law of your place of residence provides otherwise.
